Simchalam land dispute

Sir, We have a residential plot in Simhachalam (Visakhapatnam District. At Present land registration is banned by AP Govt as Simhachalam devasthanam claims that the lands belong to them. Some 20000 plot owners are facing the same issue in that area) which is purchased by my Father on my Mother's Name during 1980s.

At Present, My Mother in her late 70s wish to give the power of attorney to one of her sons as land registrations are not permitted by Govt. My Query is

1. Is Power of attorney is possible to be given as no registration is permitted by Govt now
2. If not, Please let us know the alternative

Partition of property

Sir,

My three brothers jointly have got registered four house properties owned by my father (late) by giving monitory compensation to me and my Mother (the same is written in the registered document too) and getting our signatures (myself and my mother) on the registered document.

Recently one of my brothers (he has wife and two minor daughters) passed away. My queries are

1. Now, my remaining two brothers want to separate house properties in individual names. Is the signature of my deceased brother's family members (his wife, two minor daughters and my mother) required?? This question is being asked as some lawyers say that since document is registered in joint names, signature of my deceased brother's family members (his wife, two minor daughters and my mother) are not required.

2. My Mother has one plot registered in her name during my father's period. Now, she wants to get it registered in the name of the wife of my deceased brother.. What is the procedure?? Whose signatures are required for registration??

3. 2. My Mother has one more plot registered in her name during my father's period. Now, she wants to get it registered in the name of one of the two living brothers. But, since the land is under registration prohibited properties list due to disputes between Simhachalam Devasthanam and Andhra Government, and since, no body can predict when this issue gets resolved, What is the procedure as she wants an option to transfer her rights at any cost before anything happens to my Mother?? Whose signatures are required for registration??

Police framing a false case

As we know that Section 198(1) in The Code Of Criminal Procedure, 1973 comes into force with respect to any offences related to marriage, in one of the cases, FIR/Case is booked against a boy after receiving complaint from the father of the girl but not the girl. So, can we consider that the police were bribed to book a case against innocent boy and the case has no locus standi??

The summary of the case is as follows: A boy was engaged to a rich man's daughter. But, one day before marriage, the boy approached the rich man and said that he is not going to marry his daughter citing that he is already in love with another woman. The rich man became furious, filed a complaint in the police station(but not the girl whom the boy is supposed to marry) citing all false allegations like he came to know that boy is already married, the boy has cheated them by taking dowry before marriage etc. A case is booked (u/s 3&4 of DP act r/w 417 and 420 r/w 34 IPC) The boy and his family were arrested and released on bail after few days. The case is still running in the court.

My query is when the police framed the case illegally, can the boy request the court for taking action against the police who filed an illegal case?? Please advise

Partition deed among co owners of house and land properties

Sir, one House and 3 land plot Properties ( in Andhra Pradesh )are in Joint ownership among three brothers (after removing the rights of Mother and Sister legally.). Recently one of the brothers has passed away. He has Legal heirs (Wife, two minor daughters, Mother). Out of the remaining two brothers, one of them is settled in USA and has no intention to return to India.

Now, the remaining two brothers and the wife of deceased brother discussed on the properties and decided on which property should go to whom so that they can separate away. I request you to please let us know the procedure of separation

Non disclosure of pending case at the time of appointment

Sir, can you please advise similar judgements to Avtar Singh Vs.Union of India & Ors. Supreme Court of India 21 July, 2016 as I need support of Judgement on In a case trivial in nature in which conviction had been recorded, such as shouting slogans at young age or for a petty offence which if disclosed would not have rendered an incumbent unfit for post in question, the employer may, in its discretion, ignore such suppression of fact or false information by condoning the lapse.

Original land documents not available

Sir, I am from Andhra Pradesh. Can I sell my land with certified copies obtained online (My original documents were not available with me). I also have my name registed in Mee Bhumi (I have e pass book in my name)

Simhachalam temple land issues

Sir, My aunt purchased a land in Simhachalam in 1998. (Simhachalam lands were later claimed to be illegal occupation by Simhachalam Temple. As a result, Court has put stay on all the transactions occurring in this area. Till now, no solution is provided by AP Government or AP High court.) In the meantime, my aunt now aged 90, wants to dispose off the property by selling it or by providing GPA to me. Please advise

Lok adalat award and its credibility

Sir, An Award was passed by Lok Adalat in 2013 in relation with a Matrimonial dispute under sections 420, 498A (A marriage was stopped before two days of scheduled date as Bride groom refused to marry as he is love with another girl. So, the Bride's parents filed 420, 498A cases against the bridegroom in 2009) I would like to know whether an award passed by Lok Adalat can be considered as Honorable aquittal?? If Yes, I would like to request you to please send supporting Judgement.

Land documents

Sir, I have purchased 2 acres of an agricultural land in Andhra Pradesh along with my relative with 50:50 partnership (1 acre in my name and 1 acre in my relative's name). The registered documents of mine are also kept with my relative because of our plan to convert the agricultural land into residential land and sell them. Recently, I and my relative had disputes on other issues and I asked him to give my land documents for which he refused to give. My Queries are:

1. What should I do now??
2. Can my relative sell away my land without my notice??
3. How can I get back my land documents??

Non disclosure of pending case at time of joining govt job

In Avtar Singh Vs Union of India Case, Hon'ble Supreme Court of India has given Judgment given on 21.07.2016. In that Judgment, 11 points are mentioned by Hon'ble Supreme Court regarding non disclosure of pending cases while applying for Govt Jobs. I would like to know the view of Hon'ble Supreme Court through you (experts) because point no 1 (38.1) says that the candidate should disclose the details of pending cases. But point no 4.1 (38.4.1) says that in case of trivial cases, even though the candidate did not disclose the details of pending cases, it can be condoned. I would like to know whether the judgment is in favor of employee or employer. Because, based on point no 1, Employer can terminate the employee in case of non disclosure of cases. Again based on point 4.1, Employee can have the right to get back his job in case of non disclosure of cases. Please clarify my doubt
