Simhachalam temple land issues

Sir, My aunt purchased a land in Simhachalam in 1998. (Simhachalam lands were later claimed to be illegal occupation by Simhachalam Temple. As a result, Court has put stay on all the transactions occurring in this area. Till now, no solution is provided by AP Government or AP High court.) In the meantime, my aunt now aged 90, wants to dispose off the property by selling it or by providing GPA to me. Please advise

As it is pending in the High Court, your aunt cannot do any transfer even a GPA. It is better your aunt may execute a "Will" with two witnesses and scribe on a white paper mentioning you as an "Executor" (means you shall do the property as she directed) and sealed in a cover with her signature and deposit it in the District Registrar Office. She will have the power to withdraw and re-deposit it. After her lifetime, producing a copy of her death certificate and can open it by the District Registrar.

Alternatively, your grandma can file petition for permission to transfer to you or her close relative and adjoining the affidavit/ application by the transferee to implead into the case and to abide by the order of the Court.
