Can you please help me to understand Anand marriage act 1909.... How it's different from HINDU MARRIAGE ACT...

previously it was known as THE ANAND MARRIAGE ACT 1909 but now that law updated to THE ANAND MARRIAGE ACT 2012 (for sikhs ).....

Respected RAJENDRA sir..i want to know , in which conditions marriage will legal and illegal according to this act....who can marry or not marry /??

The Anand Marriage Act 1909
[Act No. 7 of 1909)


An Act to remove doubts as to the validity of the marriage ceremony common among the Sikhs called Anand.

Whereas it is expedient to remove any doubts as to the validity of the marriage ceremony common among the Sikhs called Anand;






2. Validity of Anand Marriage.

All marriages, which may be or may have been duly solemnized according to the Sikh Marriage ceremony called Anand shall be and shall be deemed to have been with effect from the date of the solemnization of each respectively, good and valid in law.

3. Exemption of certain marriages from Act.

Nothing in this Act shall apply to-

(a) Any marriage between persons not professing the Sikh religion, or

(b) Any marriage, which has been judicially declared to be null and void.


THE HINDU MARRIAGE ACT, 1955

1 Short title and extent. —
(1) This Act may be called the Hindu Marriage Act, 1955.
(2) It extends to the whole of India except the State of Jammu and Kashmir 1 , and applies also to Hindus domiciled in the territories to which this Act extends who are outside the said territories.
2 Application of Act. —
(1) This Act applies—
(a) to any person who is a Hindu by religion in any of its forms or developments, including a Virashaiva, a Lingayat or a follower of the Brahmo, Prarthana or Arya Samaj,
(b) to any person who is a Buddhist, Jaina or Sikh by religion, and
(c) to any other person domiciled in the territories to which this Act extends who is not a Muslim, Christian, Parsi or Jew by religion, unless it is proved that any such person would not have been governed by the Hindu law or by any custom or usage as part of that law in respect of any of the matters dealt with herein if this Act had not been passed.

divorce , age limit , consanguinity aspects are same here as HMA??

or this act have different eligibility criteria ?

Anand marriage act does not provide for divorce as per the Anand Marriage Act amendment Bill 2012. If any couple opting for divorce have to approach the HMA. It has also been renamed as Anand Karaj Act

Pratap,

consanguinity relates to genetic relationships.First cousins cannot marry under this act.Go through the features of this act completely and U will get the desired answers

Dear DR.Vashista,

I try to let the querist know what his query is and what he wants from the forum.Some of them are adamant in their expression and keep irritating the experts.I just try to impress upon the querist to understand what we are replying.Of course every expert has his own version of dealing with a particular case. But the querist has to pick out the best possible reply from the experts.most of the time I try to counsel the querist .

About consanguinity query:
Nothing in this Act shall be deemed to validate any marriage between persons who are related to each other in any degree of consanguinity or affinity which would, according to the customary law of Sikhs, render a marriage between them illegal.
