will

Querist : Anonymous (Querist) 22 December 2009 This query is : Resolved
Can the executant of a will also be the sole beneficiary also ?
Devajyoti Barman (Expert) 22 December 2009
How this is feasible as it would defeat the very purpose of the will and if executed that would have no legal implication at all.
n.k.sarin (Expert) 22 December 2009
repeated query.
Adv Archana Deshmukh (Expert) 22 December 2009
How it is possible?? Because the WILL comes into operation only after the death of the executant....

In thewill the testator will write that the executors of the will should all his money etc.be spent for paying to the debtors, religious ceremonies, donations to the deity etc. and thus a dead person would be beneficiary.

testator of a will has made his wife the executant as well as the sole beneficiary. Is this possible according to law ?
A V Vishal (Expert) 23 December 2009
Some simple terms to understand about wills:
Testator: A person who makes his will is a testator.

Executor: A person who executes the contents of the Will after the demise of the testator is called the executor. The executor is the legal representative for all purposes of the deceased person.

Legatee/ Beneficiary: Legatee is a person who inherits the estate. You should state how you wish your assets to be distributed. This includes naming one or more persons whom, you would like to receive all or part of your estate when you die, and who will benefit if your first choice beneficiary (or second or third) predeceases you.

By wrong usage of words rather asking your query in simple words you have not got the desired reply. I presume by executant you mean as one who executes the will after the death of the testator, Yes it is possible Mr Anonymous.
