dear sirs,
i would like to know what is cersai charges in home loan.
and bank can take cersai charges from borrower even the loan is not disburshed.
and if cersai charges is due for the payment for particular loan account and loan amount is not disburshed then what it means.
i request you to reply please.

Cersai stands for Central Registry of Securitization Asset Reconstruction and Security Interest of India.
Normally due diligence in regard to an immovable property used to be done only with regard to entries in Sub-Regiatrar's records. Since whenever equitable mortgage of a property is done the same is not getting registered with Sub-Regiatrar, there have been many instances where property used to be sold to gullible purchaser, while the property was under mortgage (because the purchaser will not come to know about tfe mortgage even by inspecting the records available in Sub-Regiatrar's office) and the purchaser used to suffer.
In order to plug this loop-hole, now it is required that equitable mortgage has to be registered with CERSAI. Therefore apart from sub-registrar record one has to verify the CERSAI record also to ensure that the property is free from all kinds of encumbrances.
This process is before sanctioning/disbursement of loan amount.
Therefore this charge is payable to bank whether or not the loan is sanctioned/disbursed.

sir, cersai charges is taken by bank even loan is not disburshed that means cersai charges applicable to search the property also.
does cersai charges due for payment means loan is disburshed.
