Respected members,
I represents electricity company.order u/s 125 has been passed against one of our employee ordering electricity company to deduct Rs 7000/- from the salary of employee and deposit in court.this order comes to the notice of company belatedly.the amounts which needs to be deposit in court comes to Rs 100000/-.Arrears of Rs 49000/- comes from Head office in name of employee.The company immidiately deposited Rs 49000/-in court.Now employee has resigned from the service.There is no amount is in hand of company except Gratuity. can company deduct Balance amount ie Rs 51000/-From Gratuity?in order to follow court order. if not,What are consequences of not following Hon'ble court order.Thanks in Advance

Supervisor - workman - contract labour act....?

Respected Experts,

Incase a contractor appoints a supervisor against a job contract/labour contract then should his name be included in muster roll and wage register as per CL(R&A.) act. Because a supervisor is not a workman as per the definition of workman under the said act. Need Urgent suggestion please.

Forfeiture - leave encashment + employer pf

Dear Experts,

Wish you very happy Good Morning.....!!!

What are the circumstances in which employer can forfeit Leave Encashment + Employer's PF Share of employee.

Can employer can incorporate such clause in Service Rules or Certified Standing Orders of establishment ?

02nd october - gandhi jayanti - national holiday?

Dear Seniors,

We are a manufacturing company in Chakan, Pune, Maharashtra covered under Factories Act, Maharashtra Rules.

Is it complusory to declare Gandhi Jayanti as National Holiday ( as the Act or Rule does not speak about declaring any day as Complusory Holiday )

Gratuity - it exemptions - 01 time ?

Dear Seniors,

If the employee at the time of separation receives gratuity which is Tax free as per IT Act provsion; if the said employee joins another organization & become eligible for Gratuity then is this Gratuity is tax free upto upper limit of Gratuity amount or for only one time the Gratuity Amount would be Tax free.

Canteen contractor - service tax

Dear Seniors,

We have engaged small canteen contractors

1) Tea Provider 2) Food provider

both the contracotrs are not having service tax numbers. In this case can we avail service from them in absence of Service Tax Number?

Land laws - maharashtra

Dear Experts,

We are planning to set up manufturing set up in around 10 acres in Baramati MIDC - Maharashtra.

We do have 02 options
1) Purchase agriculture land & to convert it into Industrial NA Plot then how much area construction we can make to this 10 acres as per Maharashtra Act & Rules...?

2) 10 acres land in MIDC area then how much area we can bulit up in this 10 acre MIDC land.?
