Gift deed with wrong survey number

Querist : Anonymous (Querist) 16 July 2025 This query is : Resolved
Can we challenge if the gift deed has wrong survey number mention in it Is it not necessary to make rectification deed for it?
kavksatyanarayana (Expert) 16 July 2025
It can be rectified through a registered rectification deed to the Gift deed with the correct survey number.

But if the donor had made the gift deed 18 month ago and died without making rectification deed then can this gift deed be revoked or still there is an alternative way of making the rectification deed?
Dr. J C Vashista (Expert) 17 July 2025
The donee has to file a suit in civil court for declaration of correct description of donated property, if the donor is expired.
Seek professional services of a local prudent lawyer.

Thank you Dr. J C Vashista. I have challenged this gift deed and said to court that they had enough time for making rectification deed (18 months) but they have failed to do so, so now this gift deed should be cancelled. Also they had made 3 gift deed on the same day for all the property that belongs to father. They have executed 2 but somehow they did not executed this particular gift deed. So creates a dought why it was not executed and rectified when my father was alive. On this ground I have suite a file. Is there any sense in this?
kavksatyanarayana (Expert) 17 July 2025
There is a suit in the court then you shall wait for court orders. You stated in your first query which is different with other queries.
Dr. J C Vashista (Expert) 19 July 2025
There are various legal issues involved in your query.
It is advisable to contact, consult and engage a local prudent lawyer for proper analyses of facts and professional guidance.
P. Venu (Expert) 21 July 2025
Admittedly, the matter is pending in the court and the only option is to await the decision. However, a mere mistake in survey may not be sufficient to invalidate the deed if it has been properly executed, the properties being well marked and the donees being in possession.
