Notice return money of the company

One of our employee was serving on our vessel, assaulted badly his colleague. Our Ship was in US high sea area and we decided not file any complaint against him as this will ruin his entire career and life. Onboard Captain decided to relieve him from the duty from immediate effect. The seaman had gone with 9 months conract period but due to this act we releived him in before complation of the contract on the ground of poor performance and assualt on board the vessel.
He was asked to report to our office to clear all final dues but he did not come. He is to pay around USD 2000 to the company. we have been trying contacting him but he is not answering our calls. We want to serv him a notice for the same.

Can anybody help me with a draft notice.

Divorce

The query is regarding Divorce. One friend got married in 2006. She has a child of 6 months and want to file divorce. Her husband is threatening to claim the baby, if she files the divorce. Currently, she is not into the job and will be staying with her parents only. Both have been staying away from last 9 months. Her husband stays alone in Mumbai. She has mother-in-law, who is again not in speaking terms.

Her husband does not want to give divorce.

The queries are:
1) What are the chances of getting Divorce on the ground Harrassmant by husband and mother-in-law.

2) What are th chances of losing baby to her husband.

Please advise.

Labour Union or Group

Dear All,

I am working in a Shipmanagement Co. Mumbai. Our core activity is to man and manage the vessels with regard to onboard staff.

My query is: As this a very small industry, the employees faces problems which are very common to all other companies. Problems are like sacking any employee without any notice, not giving permanent status to the employees even if they have been working since 2-3 yrs.

Viewing this scenario, can employees from the industry as a whole form a union or group with legal identity which can stand together when there is any such wrongs happens with any of the employee.

If yes, what could be the procedure to make such identity to safeguard the employees future.

Divorce and related matters

Dear All,

My friend 'A' (woman) needs to file for Divorce. It has been more then 3 yrs of her marriage and does not have any child as well. She has been facing mental harassment since two years.
She had expressed her intention about divorce to her husband 'B'and her parents as well. B is not in agreement to give divorce.

Now, B is asking A to transfer all the Fixed deposits to his name. The amount of FD is 12 lacs INR. As of now the FDs are in the name of A and are lying with her father.
Both residing separately at different places and are employed.

Our query:
1. Can we take compel B to give divorce before actually transference FDs.

2. Do A has to bear a huge cost if she files divorce application in court.

3.As, A is in Hyderabad, B is in Bangalore, Parents and mather-in- law (widow) arein Rajasthan. Marriage was solemnized and registered in Rajasthan; where she should file the application for divorce

4. Is there any other way out for A to get rid off B.

5. How much time it takes for a case to come to finalization.

6. What could be the compliaction on the part of A.

Please help us.

Salary issue

Dear All,
I have worked with a company for almost 5 months i.e. 3 March - 21st July. I was on probation period during this period. I left the co. due to some personal reason. According to appointment letter I had to give 15 days prior notice before resigning. I gave the notice on 11th of july but i left the job on 21st of July only. Till date I didn't get my June month salary which became due on 7th of july.
I have mailed my previous employer regarding my the salary matter, but he replied that, I have to be there in person to fulfill full & final settlement procedure and then only I can get the due amount, if any.
Only 50% of my June month salary was transferd to my account on 7th of July reason being insufficiency of funds.
the rest 50% is stil due. They purposely stopped my salary
Now my query is that, is it necessary to follow the full & final settlement procedure as for me it is not possible to visit the last co. again.
Can i claim for 20 days worked in the month of july also.

Can i file a case where i am staying at present.

Is Limitation Act applies in this case? If yes, then what is the time limit in which I can sue the company.

Land laws... agricultural land

Dear All,

Kindly suggest me on the following:

'A' is an owner of an agriculture land. His younger brother 'B' is using that land since more than 40 yrs. 'B' is enjoing the income out of farming. He has put tube-well for the farming purpose.
It was actually transfered to 'B' oraly by his father but nothng was taken in written.
Now as 'B' has been using and earning out of it since more than 40 yrs can we say that the said piece of land has become B's property.
Does limitation act applies in this case.

Min. Wages Act

Dear All,
Is Min Wages Act becomes applicable to company head quartered in Mumbai having no other regd. branches in other parts of India.

But carrying on business on project basis on the client site in Delhi and some other places.

If it is applicable then which rates would be applicable to the co., Mumbai or Delhi rates?

From where I can get the various notifications related to this matter.

What are the different rates according to Mumbai and Delhi for graduates, under graduates, 12 pass ans below that.

Minimum Wages Act

Hi all

Can any one give me the description regarding Min. Wages applicable for graduates and under graduates for Delhi and Mumbai.

Kindly mention where it is mentioned in the respective act and rules made there under.
