missing of wife

sir,

i have married girl two month back in temple without her parents consent ,she is 25 working in infosis and i am working for TCS , but now my father in law by using his muscels power take his daughter to his home , now not let her to come to my house,

my marriage has taken place before lots of people,my parents was also present, all photos are the,
now how could i bring my wife back,

shuld i file crininal case against my father in law with advocates or is there any other ways get my wife back

please suggest me

Since you both are majors and got married on your own mutually no one can separate you both. Suggest you to file a police complaint against your in laws, send copy of the same to the DSP, SP, Commissioner for record and wait until further action is initiated, if no action is taken then you can approach the court.

File police complaint against the parents of your wife along with proof of marriage.

Don't induldge ur in laws in criminal case from ur side. It may be harmfull for ur married life. You should file RCR.

Filing of suit for restitution of conjugal rights seems to be the good option in the present circumstances.
If you are sure that your wife wants to come back but it her parents who restrained her to come back then you could also file writ in the high court for habeous corpus alleging that her parents have kept her hidden in an undisclosed place.

I fully agree with the views of Mr.Barman as before initiating any action in this regard,you should make sure that your wife support your moves.

A.FILE AN APPLICATION UNDER SEC.9 OF HINDU MARRIAGE ACT FOR RESTITUTION OF CONJUGAL RIGHTS AND MENTION ALL FACTS AND ALSO MENTION THAT YOU WERE MARRIED AND ARE WILLING TO ACCEPT YOUR WIFE AT YOUR HOUSE.YOU HAVE TO ENCLOSE ALL PROOFS OF MARRIAGE ALONG WITH THIS APPLICATION.
COURT WILL ISSUE NOTICE TO YOUR WIFE AND HAS TO REPLY IN COURT.BUT THIS IS A CIVIL COURT MATTER AND IN CASE SHE HAS RESISTANCE FROM HER PARENTS THEY MAY NOT ALLOW HER TO ATTEND THE COURT.
B. YOU HAVE ANOTHER OPTION TO FILE A WRIT PETITION OF HEBAES CORPES IN THE HIGH COURT MENTIONING ALL FACTS AND ENCLOSING ALL PROOFS OF MARRIAGE.COURT WILL ISSUE NOTICE TO THE DIST SUPDT.OF POLICE AND ORDER HIM TO PRODUCE YOUR WIFE BEFORE THE COURT AND COURT WILL ASK THE LADY HER OPTION AND DESIRE TO JOIN YOU OR STAY WITH HER PARENTS.THIS IS THE BEST OPTION PLEASE NOTE.GET THE PETITION DRAFTED FROM LEGAL EXPERTS.YOU WILL SUCCEED.
C.YOU HAVE ANOTHER OPTION OF FILING THE POLICE COMPLAINT AND SENDING COPY TO THE DIST SUPDT OF POLICE MENTIONING ALL FACTS.
BUT KINDLY NOTE THAT AS THE PARENTS OF YOUR WIFE ARE HAVING GOOD INFLUENCE IN THE AREA,YOU YOURSELF MAY COME IN TO TROUBLE PLEASE NOTE.
