Surname changed after marriage now how to apply for govt. jobs

(Querist) 11 May 2015 This query is : Resolved
Dear Sir / Madam,

My wife's surname changed from AGRAWAL to JAIN after marriage.

But her all the educational certificates are with the surname AGRAWAL.

Now a days one have to apply for govt jobs mostly through online mode & so they do not accepts any educational certificates at the time of application submission. There is no verification done during the recruitment process

Documents are checked only for those who are shortlisted & called after passing the exam.

In online mode of application submission (For Example in RPSC), they ask to fill the name of candidate as per his/her Xth marksheet.

So a married woman cannot fill in the form her husbands surname while applying for RPSC exams (or other govt exams) in Rajasthan.

My query is that:

Taking into account the above facts, If my wife fills RPSC exam form (or any other Rajasthan govt. exam forms) with the surname AGRAWAL (Maiden's surname) & passes the exam. As & when she will be called for document verification & produces marriage certificate & affidavit / gazzete then:

WILL the appointing authority can give her the appointment with surname JAIN (husband surname)on producing of relevant supporting documents irrespective of the fact that she had filled the application form with the surname AGRAWAL (online form restrictions)?

Please resole my query at the earliest. Thanks in advance.

There is no legal necessity that the wife's name or surname should be changed after marriage. What is the problem if your wife continues with her original surname?

The job ad and guidelines must be having the clarification regarding the issue, refer the same.

As all the marks sheets and certificates are in her maiden name, she can continue that name while applying for jobs and let the appointment letter (if selected) be in her maiden name. What is the problem?

Change of surname for a woman after marriage is not mandatory. All her testimonials will contain her maiden surname only.Don;t get confused with that aspect.

Dear All,

My question is still unanswered.

As already told that My wife's surname changed from AGRAWAL to JAIN in Marriage certificate & affidavit.

My question is again same:
WILL the appointing authority (Govt. Sector) can give her the appointment with surname JAIN (husband surname)on producing of relevant supporting documents (Like Marriage Certificate etc.) irrespective of the fact that she had filled the application form with the surname AGRAWAL (online form restrictions)?

Why you are so obsessed that your wife should have your surname. There is no such legal requirement.
vivekjain (Querist) 13 May 2015
Dear Venu Sir,

I have initially told that the surname has already been changed in Marriage Certificate & in the affidavit signed by magistrate.

Now in the light of above fact please reply to my query?

SHe is not the first or last lady on earth to have changed surname after marriage.

She is also not the first and last lady on earth who after such change applied for Govt job.

From your query it seems that she is selected for the job and you are the dealing clerk who is about to type the appointment letter.

Your query is not at all legal. It is a matter of procedure which can be advised by the concerned deptt whom you have not approached so far.

First of all applying for the job with the changed name i not legally valid because the certificate contains different name to that of the application of the applicant (even the change in surname is a name different to that of the original one), if change of name was not applied for following the required procedures meant for it, the candidature is likely to be rejected because the candidate's name differs to that of the certificate and the application. Mere changing the surname in the marriage certificate will not be sufficient to prove that she has changed her name, neither there is any mandatory rule that a lady has to change her surname after her marriage to justify your fancy ideas. Wait for the appointment authority's decision on the application for employment.
Sudhir Kumar, Advocate (Expert) 14 May 2015
even if a lady is in service she can change her surname on marriage by a simple procedure.

Your wife is not first or last such case.

I agree that it is not mandatory for a lady to change surname but it is also not obligatory for her not to change. It is her choice and she cannot be denied jopb on the basis of the same.

You are just wasting time as you have not projected any legal query.

Your query is procedural.
