complaint against doctor.

A Homepathy doctor had been treated me for near abt 3 years for skin dieses. Sevaral times I made request him that, if he is not able to quer my dieses then tell me frankly to enable me to for anther doctor. His consulting fees for every 15 days is Rs.120/- Every time he has made falls commitment & assured that he will give me proper treatment to quer the dieses but till the date there is no improvement.

Neither written prescription nor payment receipt is availabel with me. All history and regular development have been noted but record is available with him.

In this case can I go for legal action/ proceeding against Doctor and How?

Pls guide me.

If you want to take any legal action/ proceeding against Doctor, you should have some case file given by the hospital, written prescription etc to show that you did took any such treatment from that doctor.

you can move agains the doctor proided you have sufficient evidence to prove his guilt.

try to extract some record out of him.

You are advised hereby, file a complaint against the doctor in your local police station. The police will inquire the matter. Later you can proceed to consumer forum with some evidence .

Khaleel! You know Hon'ble SC has prescribed in detail that no FIR can directly be filed against a doctor untill his negligence is got proved/opinion is sought from the experts medical experts (generally CMO of nearest civil hospital) so there is no use to make any complaint to local police as you have even no record of your treatment and another question shall also arise:

Why did you waited for a long period of 3 years to tell this fact and seek steps to be taken in this community?

Why didn't you made complaint against him and why didn't you change your doctor or treatment upto this long period?

Having no record and delay are two major hurdles in your way, however, you may try to negotiate with that doctor for at least return of your expenses.

To show the treatment by the doctor documents are necessary without the documents you cannot do any thing.
You are a consumer of a doctor, it is his duty to provide better service and treatment to you, which is not done by the doctor.
You can file a consumer case against the doctor, but needs documents. Try to take the documents from him.

I agree with kiranji,try to extract records some how, do u have consultation card with u, which u renew it every 15 days while paying consultation charges? if u have, then go directly to forum without issue of notice, file case and call for medico-records of treatments, in ur complaint u have to allege that he is purposely avoiding to give any prescription; as such no documents are produced; for production of documents call for is significant and as such application is moved along with complaint. And to certain extent i agree with raj makkadji. What type of skin problem do u have? any pigmentation problem,blemishes, pimple acne etcc.. so what i suggest is change the doctor and go to the best dermetologist and laser treatment hospitals.

Thank you very much for guidance.
The documents available with me is that

1) Registration Card.
2) One hand written treatment detailsp in short while referring me to his senior doctor who is located at Pune.

3)My history/Details of past treatment etc have been noted by that Pune based doctor & copy of the same is available with me.

4)copy of pymnt receipt Rs.1300/- two times paid to that doctor is also available with me.

Is it possible to go ahead with these supporting documents.

Pls.advise.
