Intestate succession_married daughter share

Respected sir,

Recently my uncle was expired without any will. before died he was purchased one flat and registered on his name only. Presently the family members are wife, one son and two daughters. two daughters are married. My question is married daughters are eligible to share the flat...?

Yes the married daughters have equal share in the property of father deceased intestate .

You have posted that the Uncle has expired recently............It is believed that he was Hindu and died after amendment in 2005 to Hindu Succession Act and thus succession has opened after 2005.

So married daughters shall be treated at pare with sons and share the estate equally with spouse/sons.....

They have equal share.

Sons and daughters have several rights as a coparcener. For instance, they get a right in ancestral property by birth; right to survivorship, if one coparcener dies the property gets divided among the rest. They are in joint possession and ownership of property and if they want partition, they can claim so by filing a partition suit.
