Limitation

(Querist) 10 October 2013 This query is : Resolved
1.what is the period of limitation for filing a suit for declaration to nullify and declare the sale is not binding upon the plaintiff?(The sale deed is a Registered sale deed executed more than 13 years ago). Is the Limitation is to be reckoned from the date of knowledge of the plaintiff. Is there not a maxim that Registration of a document will amount to knowledge from the date of Registration of the document?

The limitation of 3 years shall start from the date of the knowledge of the registration of the sale-deed and not from the date of registration itself.
Dr J C Vashista (Expert) 11 October 2013
I agree with Sh. R K Nanda and the suit/ case cannot survive at this stage
