Cohabitation with unmarried girl

(Querist) 23 March 2012 This query is : Resolved
Sir,
If I stay with any unmarried girl in my own residence alone, will it be treated as criminal offence? I am also an unmarried man of 30 years. Is there any law which may prevent me in staying in a a hotel with my girlfriend? Will I be held up although I donot intercourse with her?
Please make me clear Sir.

IF SHE IS ADULT, AND WILLING TO RESIDE, NO OFFENCE.

If she is an adult and is cohabiting willfully, no offence. It would be a live-in relation

But be careful, the same can lead to unwanted situations.

Be careful, any dispute, any fight with her, and you can face case of "RAPE" and no one can save you. All chances that you may be trapped. Better get marred with her, if both are willing.

Cohabitation with an unmarried girl and the contents are quite intresting.Iam not critisisng it,but am trying to analyse the future complications. If you are so inclined to stay with her,why don't you marry.

Kindly keep in mind the latest amendments in the laws and acts, which are pro women.Hence think before you leap.

From the query we cannot make out your intentions for such a situation. If both are adults and want to live together, it is advisable to get married and proceed to avoid several issues.

- Girl files the complaint that so and so man has given me an assurance that he will marry me or give me promotion or give me role in film or blah blah.. and under this assurance he made physical relationship with me..

Now the worst news for men folks is that above complaint is admitted and courts also take cognizance.

Although in stricter terms this is consensual relation between two adults but then thats our law at present.

I recall a case, in one of the countries similar complaint was filed by a girl, the court dismissed the complaint stating that this complaint itself is derogatory to the intelligence of females. How can females be so foolish to get into the physical relationship under such proposal, if they feel that their chastity is so important to them. It was further observed that at the worst this tantamounts to selling your body for some favours, certainly rape charges on men in such cases is not tenable.

So my dear friend, that girl may be staying with you, i do not know for what reasons, but ensure that she does not file a case against you in future.

In our society despite SC accepting the live in arrangement, it is not done.

1. Living with an unmarried major girl is not an offence.
2. Domestic Violence Act recignizes the relationship as "relationship in the nature of marriage" and provides certian remedies.
3 Long cohabitation will be recognized as marriage by the Courts for protecting the legitimacy of the kids born to the couple.
4. As the relationship cannot be proved by Certificate etc, you run the risk if you live in a hotel.
5. Proof of the fact that you have a live-in relationship openly in your own house will protect you from charge of rape etc.
5. If you walk out of her later, she can sue for breach of proimse to marry and claim damages.
