Lodging f.i.r - any period limit

My Father in law has attempted to murder me 5 months back and threatened me verbally that they will kill my mother if i lodge F.I.R against him. Now, my mother has gone abroad and there she is safe.

Can i lodge F.I.R against my father in law now after 5 months or not ?

FIR ITSELF STATES THAT IT IS FIRST INFORMATION REPORT. this cannot be done now as 5 nmonths are over for the incident. but from your side you can state that he indeed gave threats 5 months back abnnd strating from there till today ot os continues and hence FIR can be lodged.

Whenever you can lodge a complaint against the person. But you are the responsible for that delay in register the f.i.r. F.i.r can be registered. But you have a weak case. Its will be defeat in trial..

You can file an FIR explain the cause of delay,but in your case without any injury report your complain may be register as a general diary not an FIR.

A Fir demands prompt reporting soon after the incidence takes place otherwise doubts are costed on it that it was not any incidence but a well advised plan action.So unless one can reasonably count for delays it is not advisable more particularly in your case in hand is my opinion.

though you can leave a complain before concerned police station and request for inquiry by the police as threat may possibly be converted into substantial act by the offender some day( as may the threat giver is under preparatory stage), once the Concerned IO is satisfied and found any substantiality it can further be converted into a FIR ...

I have no other opinion as of other experts on his issue. None can believe upon you waiting till 5 months for lodging FIR against such serious offence. Go ahead if you can.
