final report

(Querist) 28 April 2011 This query is : Resolved 
i was accused in the year 2003 under 420,409 & after investigation police dint find any thing wrong against me.
police has submitted Final report & request the court to close the case in the year 2005.
in the last six years i do not received any summon from court.

please let me know what to do in this situation.

the case stands closed and no charges framed against you.

but if you are still apprehensive then take help of some local lawyer and find out the final orders passed in the matter.

You can check up with the concerned court, whether the FIR is closed or not.

go to the concerning court and get the status of the case!

The court can accept the Final Report only after notice is sent to the de facto complainant and on his appearance after hearing him.
Without hearing the de facto complainant the court can not accept Final Report.
So check with the court whether the de facto has given any version or not.
Mere submission of Final Report does not mean your discharge.

because without questioning you the court will not close your case.. either acquital or conviction.. so just contact your advocate..

According to my lawyer several time notice has been sent to the de facto complainant but they are refusing to accept the court notice.

You have also to ascertain from your lawyer whether the notice was sent by Registered Post and the said post came back with the postal remarks "refused" or the notice was sought to be served through the court processor and the court processor has given report "refused to accept".
I think your lawyer has to be little bit proactive and ensure that the case against you get closed at the earliest.
