Received a blank check against payment in security

Dear Sir,

Here are the facts of my case...

1. Met an associate to discuss on film making In august 2021, started working in office since 19 dec 2021.
2. The agreed terms were as follows:
• I asked for a basic pay that was denied, i was told all expenses will be paid(fooding and accommodation, travel and other necessary)
• It was agreed that i will be joining as a partner in profits, no capital investment on my part all the investment and expenses were to be paid by other part.
• An agreement was made(MOU) stating that i will be appointed as the ceo for the company. That to protect my interests on the agreement binding a duly signed blank cheque was provided to me.
• Under this agreemnt if the company fails to keep their promises as discussed in agreement or fail to proceed with project due to any condition i am liable to use the blank cheque as in payments .
• The MOU duly signed in hard copy on company letterhead. And a xerox was provided to me with the blank cheque in original.
• Now, as of today the company seems to be playing a con on me... lingering the process and project. It seems in future it will shut down the project. Film making is a very difficult task, millions of people start with it and only a few 100 get the exit.
• Now after 2 years of efforts and time given in I am left with nothing. The company(the director) may have used my name and position to get favors and funding with might have been used in real estate(can't be sure).. but yes enjoyed the perks.
• Now I have the xerox of the agreemnt and the blank cheque, what shall i do and how do I deal with this situation.
• I have ingnored all the red flags about this party only in lieu of trust to get this project done. Now as i can see it very clearly things are not going to work out. He is a cheat. Also he is a man of resources, and he won't be paying me anything anymore. Please advise how shall i proceed.

Non payment against a cheque issued by labour court

An employee sued his employer before the Labour Court for non-payment of F&F subsequent upon his resigning from service. The employer lost the case and paid the payable amount to the Labour Court, who in turn issued a cheque to the concerned Employee for the payable amount on a bank that has since merged with another bank, in April 2020!

Employee’s bank did not present the cheque before the Acquiring bank but returned it to the Employee only stating that the bank has since merged with another bank!

Would the matter fall under the scope of 'cheque dishonour' and attract provisions of Sec 138 NIA? Would a notice u/s 80 CPC also become necessary, which require a minimum of two months time before initiating any legal action?

Labour court is harassing the employee and not issuing a fresh cheque on one pretext or the other!

If the matter does not fall u/s 138 NIA, what would be the provision under which the employee can proceed against the Labour Court and would there be any limitation period for initiating such an action?

Any advice would be highly appreciated. Thanks in advance!

Resignation withdrawn and rejoining

Sir, i had served an autonomous body for month 1year 8 month after that i had resign on 2023 dec 16 & join state govt. Aided service,but not take money and don't submit document for salary starting,,,, but i know from my previous office they do not accepted my resignation till now bcoz executive meeting not done .
Can I rejoin back my previous office???
Now i want to rejoin.

Please suggest can i have any possibilities for rejoin..

Pay protection with regularisation

Hello Sir/Mam
My name is Purno and I have been working as contractual teacher under SSA, Assam since 2013 and we are receving a sallary on ROP since 2013 with annual increment, so far we 10th increment have had been added in our sallary. Now the Govt. has given us the option to get 1) regular as a fresh candidates where our sallary will start from beggining. 2) As a contractual teachers just like at present we are.

Now my question is that how can we get regular with pay protection. Are we eligible for it? and how is it possible to get regular with pay protection? Pls advice us.

Termination of employment due to poor performance

I am working in MNC. I joined in this company on 25 july 2022. Around 6 months back, Due to delayed delivery of project, my supervisor asked me search job outside. But i did not accept. Recently he initiated performance improvement plan (PIP)and planning to terminate my service if expectations are not met. My query here is that
1. Will the employer issue termination notice if my performance is not as expected?
2. In between my supervisor finding the ways to terminate on basis of misconduct. He is shouting in meetings at me in front of people for minor things, still I am keeping quiet.
Is the employer has right to terminate on basis of misconduct during performance improvement plan? Because my supervisor is finding ways to terminate as soon as possible.
Please advice.

Employer not giving appointment letter

I m visiting faculty of one autonomous college for commerce subject.
College authorities not giving my appointment letter even after so many request.
Now I have resigned even they are not giving me the said letter.
What should I do.

For family pension

I had applied for Family Pension who was died on 12-06-2006 . He has worked in Customs and Central Excise Dept.now GST. The CAT has given 8 months time to the Dept. to settle the claim though I had submitted all the papers and clarified their observations. I am a poor divorced dependent daughter to my both deceased parents and has no income to survive myself. I have no children. Please guide me.
