Can an employer directly employ contract labour or it needs to employ them thru a contractor.

Non payment of retainership for consultancy work

Can a factory refuse to pay retainership to a consultant because he did not submit a resignation letter one month in advance and left by submitting a resignation just 4 days before he left after working for one full month? Please let me have your expert opinion?

How to handle a worker's notice who left the organsiation ?

I sent a worker who was not co-operating with other workers and amount is also settled in March 2008. He was working in my company for more nearly 4 years and in the middle of the above tenure his service was terminated twice. Now after 4 months he sent a registered letter(Not a lawyer Notice) that removal him from the service illegal and all the settlement benefits have not been given and hence to reistate him. My company is a small printing company and only 5 workers are working and no formal appointment letters are not given. Even ESI is also not covered due to the low number of employees. The said workers was mischievious and who was interacting with another worker who also left started similar business in our area. He joined with her now after the removal and giving maximum mental torrtures to me by way of anonimous letters, sms and phone calls.
Now kindly advise me what are all the legal rights he possesses to claim any amount from me. What are all the precautions i have to take to prevent further complication in this matter.

Working Hours

Hello Friends,

Govt of Gujarat has apssed a notification whereby due to power shortage, various industries have been asked to operate for 5 days.

In such a situation, can the employer compensate the additional weekly off by adding the same no of hours to other week days.

Whether such a move will require approval from the labour inspector ?

Whether overtime needs to be paid ?

Urgent Query about Providend Fund

Hi All,

My mother in law is a working woman & now she is going to resign from her job. My query is..........

Management of her company says that she may resign but she will apply for withdrawl of PF only after two months after her resignation. I want to know that is there any specific time limit to apply for PF withdrawl? If so then pls send me circular any other documents related to this.

Is License under Indian Forest Act 1927 require ?

In Dadra (Union Territory) There is an existing Factory Producing Veneer,MDF Board, Particle Board, Laminates from Wood imported from various countries.
There is one order passed by Hon. Supreme Court in writ petition in 2002 saying "No State or Union Territoty shall permit any unlicensed saw mill, veneer, plywood industries to operate"
Now this order is meant for producing all the above mention items from wood of Indian Forests. But what about Wood imported from Abroad ?? Pls. Advice

Need urgent guidance.....

Hello,
I don't know, if I'm asking this in the right platform.

I'm working in a courier company for last 12 years. recently, they botched up my payments & even the TDS. Virtually nothing is matching up... Neither the Salary sheet with Form 16 or with TDS Computation(not provided to me till date). I have been pointing these issues for last eight months through emails but to no avail. Finally, with the last date of Filing return fast approaching, I had no choice but to issue a Registered letter regarding the same alongwith other issues like Harassment/intimidation by the owners.

As a result I have been verbally asked to get out of the office since 17/07/2008. All these days, I have been sending letters to them to resolve the issues pointed out in the letters & decide my fate, which they are not. However, I'm being verbally threatened time & again about slow death etc.

Please note that all my communications are through letters, for which no written reply has been issued.

Considering the gravity of situation, I urger your panel to please guide me on the legal course in the matter to safeguard my life/limbs & dignity. Also, if you can help me get a lawyer to fight for me legally.

Applicability of ESI Act

I am working in an IT & ITES company. I would like to know, is ESI Act applicable to employees of IT, ITES and employees stationed in the Head Office of the company.
