hindu sucession act

father alloted 5 acres each to his two sons but he has not given any share to his first wife?Land is amicabily given in the year 1988? first wife filed suit for partition in the remaining estate her husband 5 acres land in the year 2002?
pending the suit husband died leaving behind first wife her son and second wife and her son and three doughters then in this position what will be share of first wife in the estate of her husband?whether she is entitile to ask partition in the life time of her husband and after his demise who r the shareres?

Theft of bangle

Have your ever come across any decision of any of the h'ble high courts or h'ble supreme court regarding section 379 of ipc that without having any proper occurrence witness's deposition,a man cannot be convicted for the offense of theft soly on the base that the mentioned was arrested by the police at the time of alleged place of occurrence while the accused was seen running to get in to a bus at the bus stand

The case of the prosecution that the accused was committed theft of a bangle from a kid while the kid was kept by her mother at the time when the mother was attempted to get into a bus at the bus station.no recovery was not effected also

myself was come across with a kerala high court decision.but i could not trace out the same till date

so i am submitting to you all for your kind consideration

Dear Sir,
I have a widow sister with me for the last
15 years with her children.She has got her husband s Property as well and Now she
is asking share in father's property and
she is not ready to leave my home and she
may go to the court for asking share in
parent's land & home. and she is 55 years
old and I am 60 years old.I am not interested in giving share and I have a son

My father died before commencement of Hindu Sucession Act 1956 therefore does act applies
Please advise me

Partition suit

Dear Sir,

I have property jointly owned with
My sister and my uncle.
I planned to file partition suit in Highcourt for the same as they are not agreeing for the partition.
Could we go to mediation/arbitration to make partition.

what is the stamp duty required on probate

I have applied for probate in lease hold right property. Evidence is over, but court says your have to paid court fees on today market prise valuation of the property. please let me know what is actually court fees is payable on probate in gujarat state

Arbitration

In an agreement to construct a flat, the builder has inserted a clause which has the following phrases
1. in the event of disagreement or dispute between the builder and the client, the issue will be referred for arbitration
2. that the client has no objection to such arbitrators being nominated by the builder unilaterally without seeking consent of the client
3. Such arbitrators may even be employees of the builder's firm.
Of three, the third seems patently against the laws of natural justice: 'no man shall be a judge in his own case'. However is there any thing in the arbitration act or in case law that explicitly forbids this.

Is pre-approval from Commissioner of Income Tax is done away or still exist?

Which is the provision / notification / ciruclar supports your answer.
