Civil Law

(Querist) 01 March 2010 This query is : Resolved

Like the Criminal Courts giving Judgement/orders to the Accused immediately to the Accused. Why not the same procedure be adopted in Civil cases to avoid delay ?

Civil cases requires detail evidence, both side will have to ease their burdens, will have to prove their defense, but it is not in the criminal case, charge sheet wittnesses comes for the evidence and some time turns hostile so criminal does not take much time.
Now days procedure is changed civil cases are also disposing as early as possible.

i ve seen a Civil Judge in Jalandhar, dictating the detailed orders immediately after the arguments and that too in the open court.

it all depends upon the judge, workload, nature of suit etc.

but a well considered upon verdict is better.

Now the Depositiosn of witnesses and Judgments are computer printed

We can expect the deposition copies and judgment copies on the same day !

The required quide lines by High courts may be given to lower courts -whereever computers are provided .

Unless like Criminal judgments, the Civil cases need judgments with various findings to prove a case.

In a criminal case, a simple point like benefit of doubt will do out the accused. But the claim have to be proved in a civil case. reasons to be specifically given
