Naththam land........

dear sir / madam,
my home is grama naththam land. i want to survey to my land. i have deed form sub registar office. if i apply to taluk office my village VAO is refused. i dont have patta. i bought this land last 2011 and build a home 2012 . still now i am staying in this home. i asked VAO to why you not my land to survey like this. but VAO told this is a grama naththam land, that\'s way i can not
survey.

then how i know my land from to end ?
how to stop occupy of my land to neighbors?
how i get patta?

Consult a suitable and land related lawyer as land laws are differ from state to state.

I am also not aware.


Assuming that ( if and only if) it stands for terms used in different states say Gram Panchayat Land/Shaamlat land etc etc the revenue official may be right.



Local terms and local laws are involved.

Better to consult local counsel specializing in revenue matters and well versed with local laws.

Grama Natham is not a property of the Government and the title cannot be transferred back to the Government under the operation of Tamilnadu act III of 1905, Section 18(1) of 1948 act and land encroachment act of 1905. Grama Natham is defined in law lexicon as a land upon which houses can be built in a village. The terminology “Grama Natham” was brought into existence in order to stress that the land could be used as house sites where the owner of the land could build houses. This was used to differentiate house sites from Government held land such as Inam land (gift land), ryotwari land (currently abolished system of assessment where land revenue was imposed directly on the individual cultivators called ryots), pannai lands and waste lands.

In Grama Natham, the first occupier of the land is considered as the rightful owner and generally no Patta is issued to him/her. However it is still possible to apply for Patta when owning a Grama Natham land. Pooramboke land are often compared with Grama Natham. “Poram “ means outside and “poke” means revenue record. Hence the complete word “poramboke” can be defined as a land which lies outside the revenue records. By such definitions, any piece of land can be classified either as Privately owned Patta land, Government Poramboke land or Grama Natham land.

So if your land is situated outside the revenue estate only then you are entitled for the grant of Patta otherwise you have right to construct house and protect it from neighbours.
