Wife filed fir for theft against husband

(Querist) 31 December 2014 This query is : Resolved
Dear Sir,

I am serving in Army at posted at Glacier Laddakh. I regularly send money to my family who are in Mumbai. During my last visit, I found that my wife had purchased one expensive mobile, diamond watch without informing me. I took it in my possession along with other LIC documents which are in my name. Later she argued and asked to return it, which I didn't. She filed FIR at police station under section 406 and in her complaint falsely claimed her ornaments are also with me, which I didn't take. She has also named my brother as a partner in theft, but he was not there with me.

Kindly suggest what step should I take against the FIR.

I fail to understand why did you forcibly take possession of those documents.
Mere purchase of few articles without your permission should not make you to take such drastic steps.
Settle the dispute with your wife amicably. For this petty reason do not out the marriage at stake.

Once your wife purchased articles/ mobile SHE IS ABSOLUTE OWNER..

You cannot forcibly take away her articles.

Settle the matter amicably.
Don't send entire salary to her in future. DO NOT OVER-TRUST ...
OR U WILL BE IN REAL SOUP...

As advised by experts, better sort out the issues amicably instead of further aggravating the situation.

You are serving in the Army and periodically sending moneys to your wife. You should have ascertained from her what she does with the money. How did your brother come into the scene? Instead of fighting on the wrong purchases you should have counselled her properly. Sensitive issues are involved in this problem. You have to settle the things amicably with the help of elders. This is only a symptom. There might be bigger problems. You should be tactful in dealing with these sensitive matters. What about your parents. Is he living with them or living alone? Why the things have gone to the extent of going to police station?
