Legal notice

(Querist) 29 December 2014 This query is : Resolved 
Dear Sirs/Madams,

I had a HDFC Credit Card which expired since last two years. i had purchased Rs.18,000/- rupees vide that card.But unfortunately i failed to pay that amount due to my financial problem. After 4-5 months i got a call from HDFC Card executive regarding the settlement & i agreed their settlement amount for Rs.28,600/-.

In August 2014, i have cleared all the settlement dues.

But 01 month ago i came to know that my settlement was cancelled due to payment was not made in time.i shocked & called to HDFC People, who told me that to resettle the card.

I was refused to pay because during the settlement time HDFC Recovery Team were attached with me each n every time & never aware about this to me.

Recently i have recived a letter from HDFC lawyer saying that they will put a case against me.

Please advice me Sirs/Madams what to do as i have already paid all the settlement amounts.

Do disclose whether there was any settlement letter or not in compliance of which you made the payment. In absence of settlement letter and its due compliance the bank refuse to consider the payment as valid one.
If you have proof of such settlement and its compliance in time, you can file case in consumer forum agaist the bank.

This is general problem with credit card dealing.

If they have given any letter for settlement terms mentioning time for settlement and you have observed all conditions, you have good case in your hands otherwise you may loose.

you have failed to make payment of dues within the stipulated period . hence HDFC bank can as per terms of settlement seek to recover the balance amount from you . if you have received legal notice from HDFC you must reply to legal notice

On payment of settlement amount, did you receive settlement letter and receipts for the amount paid?

Yes Sir,

I am having those receipts as well as the settlement letter. Also i have kept the Recovery Team people's Messages,Mobile Numbers who were touched with me during the settlement process & also until the final payment made.

What was the date stipulated in the settlement letter for payment of agreed amount and when you have paid the amount?

Sir,

I took extra two months to settle all the amount which was directed by HDFC Team & i am having their msgs too. Also told me to give additional interest amount for two months apart of the settlement amount.

You offer additional interest for two months and demand for a final settlement letter. If they do not agree you go to consumer forum.

You can. According to me this is the best solution. The Bank will also agree once a written communication is sent to them.

It becomes your duty to give a reply to the legal notice. In that you mention entire episodes and seek its intervention to close this issue.
