Probation

(Querist) 19 October 2013 This query is : Resolved 
A man was convicted by trial court. Session Court give order to free man on probation in appeal but appeal was dismissed and conviction order upheld. What does the order means? Is the man free and does not have to go to jail at all? Is the order not contradictory in itself as on one hand appeal is dismissed and conviction upheld with modification of order of trial court as to probation. Does any revision lies in high court?

Order of sessions court can be challenged in HC u/s 482 crpc.

When Session Court dismissed the appeal how the court can order to free convict,it is contradictory statement. On dismissal of appeal the convict has to be sent to jail, if the convict did not get a stay order from High Court.
