Maintenance

(Querist) 18 October 2013 This query is : Resolved 
First maaried as per Muslim law.Wife didn't returned to matrimonial house for more than 2 years, husband got remarried without giving divorce to first wife.

First wife filed DV case asking for maintenance.

Question here is whether 2nd wedding to be disclosed by husband at this stage.what
Effect will it have to reduce maintenance if any. Other pros cons of same.Thank you.

A muslim can marry 4 then there is no reason
to conceal 2nd.At least it would prove besides burden to maintain parents you have two wives to maintain with earning you have.
so naturally it will have an impact on quantum of maintenance to be awarded to 1st one by court.

Disclose it to prove your added liability, so maintenance amount will decrease.

If First marriage was amde as per Sharia then the second marriage valid.

However if the first marriage was made as per Special MARRIAGE aCT,then second marriage is invalid.

You have pay maintenance to both the wives.

The maintenance is the right of your first wife irrespective of your performing of second marriage. There is no relationship of your second marriage with the maintenance of the first (divorced) wife.
