How to register a property which is already registered on a minor

(Querist) 13 March 2013 This query is : Resolved 
My Grand father registered a house on his grand son at his age of 7. now he is 13 (2013) and my grand father was passed away. now we like to do a equal partition of our assets, is it possible to register the house which is already registered on a minor with the help of court and legally, without any compulsion of the minor. if we do this partition legally is there any prob will rise in the future by the minor. is there any other way to do this equal partition. kindly clear my doubts.

In the fact situation stated by you, the property belongs ABSOLUTELY to the minor and no body else can have any share in it. It is the minor who has to decide as to what he wants to do with the property. Now being a minor, he cannot legally decide. Only after becoming a major, he can decide. Others cannot decide for him, especially against his interests.

There is no such law to get the transfer of the property of the minor in your name rather such property can be sold with the permission of the court in the name of welfare of such child.

YOU CAN NOT DO WHAT YOU JUST WANT TO DO.

YOU WILL HAVE TO WAIT FOR 5 YEARS TO LET HIM ATTAIN MAJORITY AND THEN TO NEGOTIATE WITH HIM THEN IF HE AGREES IT WOULD BE POSSIBLE OTHERWISE NOT.

AT PRESENT EVEN COURT SHALL NOT PERMIT YOU TO DO SO.

WHEN COURT GIVES PERMISSION TO SALE NORMALLY IT DIRECTS ABOUT HOW THE SALE PROCEEDS WOULD BE UTILIZED DURING HIS MINORITY.

THEN BY PERMISSION TO SALE YOU CAN NOT ACHIEVE OBJECTIVES YOU HAVE.
