How & whom to complain

lawyer appeared for a family case is now demanding more money than she asked initially, she is threatening by saying she will use the legal system to make our life difficult & that she will send police to the house, also refusing to give the order copy

what is the legal stand on fee dispute, both of us doesn't have written evidence for agreed fees but we have paid her through cheque

please advise on

1. whom shall the common man complain about the lawyer who appeared on his behalf

2. what is the legal harassment that is possible that she is threatening to enforce on us

What the lawyer is doing simply criminal. You can lodge complaint with Police. Lodging complaint with Bar Council is another option.

She can not cause any legal harassment.

send letter by REgd Post AD that you do not need her services any more . that you desire to change your lawyer . request her to give NOC

Such lawyer can do nothing against you. Lodge a complaint with Bar Council of that State and change your lawyer and even bring this issue before the trial judge.

how labourous is complaining to the bar council in terms on money & legal process

she is not willing for a amicable sloution, the trial has been completed & she is holding on to the judgement copy by demanding more money & threaten to take legal action/harassment or send police to the house

in your case trial has already been completed and judgement passed by court . you dont need a lawyer now

you can as party in case apply for copy of judgement . you will get it within a month

if i get the order copy on my own can she create any legal problems

what is the official legal stand on fee dispute between lawyer & his/her client. there is nothing in writing to support anyone but she is demanding more than what was agreed

no she cannot create problems judgement is already passed by court . case is over now .

if your lawyer states that you have not paid full fees as agreed upon she will issue you legal notice file suit for recovery of her fees . but she needs documentary evidence that _________fees had been agreed upon and you have not paid it

Getting certified copy from the court is not a big job requiring the services of the lawyer. You can do it yourself without lawyer and then resolve the matter at your own end. No harm can be made as threatened.

I do agree with R.K.Nanda,settle the matter amicably with the lawyer or change your lawyer by executing fresh Vakalatnama.Moreover you can lodge a complaint local Bar Association and State Bar Council.

Dear All,

Further to my previous query, the lawyer who asked Rs 30,000 for a family court case before appearing on our behalf for providing legal assistance has demanded Rs 1.5 lakhs after the judgement now sent a legal notice(on her letter headed paper) demanding Rs 9.5 lakhs by mentioning damages for causing mental agony etc.

Do i have to respond to this notice, if i don't am i doing a legal error.

As i said there is nothing in writing on bothsides to prove anything but we have paid that Rs 30,000 as a cheque payment.

reply to legal notice . contact a local lawyer . mention that rs 30,000 was paid in full and final settlement

Strongly reply that notice claiming heavy damages from that lawyer with threatening him to initiate all possible legal options befoe you against his illogical and unprofessional attitude and harassment.
