Reg: false 498a

(Querist) 20 December 2012 This query is : Resolved 
Sir, Is it that court will ask her to prove her 498a complaint as per FIR or if she does not prove what happens to her and the entire case will be dismissed and if she proves with any false evidences what happens to me.So, pls kindly give information in this regards. Thanking you sir.

If she fails to prove her case then you would be acquitted on lack of evidence.

However if you have prima facie proof of her false statement in court then you can bring case of perjury against her.

98%of 498A cases are false . result in acquital . if your wife gives false evidence she can be prosecuted for perjury

There is no logic to ask such query as this is of a common knowledge that if she proves her case, you shall be punished and if she fails to do so, you shall be acquitted. The right to appeal and revision lies with both parties with further litigation connected thereto.
