Cheque bounce case

(Querist) 14 August 2012 This query is : Resolved
Hi Sir,

I have filed cheque bounce case on some one who vows money to me. Case is coming to end. That person gave me a cheque of 1 lakh rupees.

Now my lawyer is asking me to get compromised for 50,000 as otherwise court will ask both the parties to compromise through LOK ADALAT .

1) Is it right ?
2) what is this LOK ADALAT ?
3) Is there any way for me to get back my whole money ?

In cheque bouncing cases generally accused requests for compromise,if your case is strong then do not agree to settle the matter through Lok Adalat but contest the same on merits.

Lok Adalat means it is stage where cases can be compromised.
You can compromise it in the lok adalat or not. Court cannot put pressure you to comrpomise, at the most it can suggest you and if it is referred judges will settle the matter if you agreed.

Do not go to LA.
V R SHROFF (Expert) 15 August 2012
Go to Lok Adalat, and Demand your Full amount and Legal Expenses with interest for Justice. Let him commit even 50,000/-
Either he will agree, or the case will be back in court , Merit of case will not be affected.
But you are folowing court direction to go to LA.
No one compel you to compromise at 50k in LA.
