Child custody and visitation right

I got divorce in 2016. She filed a Maintenance case and then withdrawn on the same year 2016.
Meanwhile, i asked my daughter to see, for that she harrased by filing DV case against me and my parents in 2019. Very unexpectedly, i didn't receive any summon/notice from the court. Looks like, she got exparte order that is, Honble Judge said that i've to pay Rs.2500 monthly maintenance for my daughter. Seems that she again claimed maintenance for her and my daughter too Domestic Violence case in 2019 act. This information recently we came to know.

Now, i want to get my 8 years old baby girl under custody. They are not allowing to see my daughter.
I'm staying in vellore and she is staying in Trichy.

Can i file a Habeas corpus writ in high court of chennai for visitations rights remedy? I've a lots of merit grounds to get my baby with me.

or Shall i need to file a custody/visitation rights case in Vellore jurisdiction?

Sale of scrapped vehicle

Dear Learned Experts

Our Trust has a Tempo Traveller which is more than 15 years, on a voluntary basis, we approached the RTO for cancelling the Registration which they have cancelled through an order.

Now a person who regularly collects our scrap items has approached us to buy the scrapped vehicle and he is willing to pay the money for the same.

While delivering can I take a letter from the person mentioning all the details of the vehicle and must not use it for any other purpose or illegal activities or should I take an affidavit or declaration from the buyer?

While taking the vehicle to the scrapyard, will traffic police raise queries about the vehicle.

Appreciate your kind suggestions and guidance in this matter.

Apartment issue

Hello,
In out apartment , Builder has made seating areas in front of apartments , which is otherwise parking /walking area. Some of the residents constantly keep sitting & chatting till late night 11pm -12am .. Even residents association is helpless .Can there be a legal recourse to remove the structure itself.

Addition of names in my brothers agricultural land in karnat

We have 3 acre agricultural land in Karnataka in my eldest brother's name. Now as anyone can buy agricultural land in Karnataka we wish to add the other 4 brother's names to this property.. What is the procedure?

Can a aggrieved individual on plain paper write and send a Legal notice or it has to go through a Lawyer.

Clarity to apply obc

Obc issuing certificate says that,

The term "Ordinarily "used here will have the same meaning as in Section 20
of the Representation of the Peoples Act, 1950.

And ,

Representation of the People Act, 1950

20. Meaning of "ordinarily resident"

52 [(1) A person shall not be deemed to be ordinarily resident in a constituency on the ground only that he owns, or is in possession of, a dwelling house therein.

(1A) A person absenting himself temporarily from his place of ordinary residence shall not by reason thereof cease to be ordinarily resident therein.


My obc certificate is given based on my dad's ordinary residence in rural area only. But the issue is my dad has only kisan pass book as address proof which is valid address proof according to government website.

And also we are not staying in village from past 10 years, and the only house we had there is not in living condition, however according to act it says that we are not ceased to be ordinary resident if we abstain from living there.

Obc issuing case worker is discarding our claims based on kisan pass book, he is demanding EPIC card or Adhar card.

Can i not get obc based on kisan pass book?

My dad wants to make a will. He is 83 and bedridden. Cannot walk, talk, read or write.
Could any one let me know whats the procedure and cost of making a will notarized.

Acceptance of resignation

Sir i writingly resigned job on 17/05/2017 but appointing authority terminate me from the job ordered on 20/01/2020 taking three years there is no enquiries on me they terminate on probationary rule 1977 how to i approach to accept my resignation

Regarding change of caste in school records

Good morning, I am a Government servant working in Karnataka since 22 years. But I filed a Suit in civil court in the year 2014 regarding caste declaration (on the basis of my father's caste - SC - Adi-dravida) and I succeeded. But in my school records it is mentioned as Christian. Further, I approached the Caste Verification Committee for scrutiny of my caste and after due verification the Tahsildar issued me the Caste certificate. Further, the my department has asked for Sinduthva certificate. The Social Welfare Department in turn sent the file to Tahsildar for verification. After all verification and keeping the file for more than three months with them, now they have asked me to change the caste in school records. I request your good self to brief me on how to get the caste corrected in my school records. I gave a representation to the school authority for that they said they cannot correct the caste in admission register by themself and have forwarded the letter to Block Education Officer. I would like to know what is the procedure ?? whether the school authority can directly change the caste in my school records or should it be directed by the BEO. Please clarify. Thanks in advance.
