cancellation/rectification of settlement deed

Dear Ld. Members,

I would like to amend/rectify a settlement deed which has been registered.

Is it necessary to revoke the settlement deed in the first instance and then make a fresh one or a rectification can be done straightaway. Please give your valuable advise. Also give me a sample deed for revocation of settlement deed

About WILL

Dear Ld Members,

I am appearing on behalf of Defendant. Brief facts of the case : Plaintiff and Defendant are cousins. Defendant's mother owned one plot measuring 200 sq.yards and there is one super structure in the said plot. The possession is with Defendant for than a decade. In the year June 1999 the mother of the defendant( as per the version of the plaintiff) executed a WILL giving 50% share to the defendant and Plaintiff. The mother of the defendant expried in July 1999.
Now the Plaintiff has filed a suit for declaration,partition, possession and interim/permanent injuction ( as there is some construction going on in the vacant portion.

Can I take the following objection/defence

1. Suit is barred by Limitation -Article 58 of the Limitation Act.
2. for permanent injunction Section 41(h) of the Specific Relief Act - When injunction not to be granted. When there is an equally and effacious remedy.

The Defendant is not aware of any such will executed by her late mother. The WILL has been signed by defendant's mother whereas she is an illetrate. We have a certified copy of one GPA executed by her in respect of another property to prove that the WILL is forged.

Now the question is can I move Order 7 rule 11 application taking the plea that the suit is time barred?

Can I get any supreme court/high court judgement relating to this dispute.

Non compliance of District forum order

Dear Ld. Members,

I had filed a consumer complaint against Delhi Vidyut Board which was decided in my favour. DVB went on appeal and the same was dismissed in-limine by the State Commission. DVB compensated me as per the district commission order. Now DVB has been privatised and taken over by New Delhi Power Company Limited. They have sent one notice to pay some amount which was the cause for filing the complaint.

Please tell me whether to contempt petition in the District Forum or the State Commission. The value is less than 20 Lacs

Right to information Act

Dear Shri. M. P. Perumal,Mr Palnitkar and Mr. Arora.

My question is still unanswered and I don't agree with you. some of the States having its own RTI Act are as follows
1. The Tamil Nadu Right to Information Act, 1997
2. The Delhi Right to Inforamtion Act, 2001
3. The Rajasthan RTI Act, 2000
4. The Orissa Right to Information Act, 2002
5. The Karnataka RTI ACt, 2000
6. Goa RTI ACt, 1997
7. The Assam RTI Act, 2000 Etc

My question whether information pertaining to a particular state government office can be sought invoking the Central Act or do I have to invoke the respective State Act. Please clarify?.

DEar Ld. Members,

Please clarify my dout. Every State Government has its own State Information Commission and Act. My question is can we seek information from State Government invoking the Central Act i.e The Right to Information Act?

Court Handbook - Civil & Criminal courts in Chennai, TN

Dear Ld Friends of TN,

May I have the detials of Civil and Criminal Courts in Chennai. In Delhi we have the Court Handbook which gives a brief discription about the number of courts, jurisdiction pecuniary as well, fees for Injunction,HMA cases etc. This is available in the court web site.
If anybody can provide me a soft copy, I would be highly grateful.Also let me know whether any book is available, if so, where?
