We have family property that original bought by my grand father then trans to my mother after his death. Now my mother is no more and we are three brothers.
My father was a banker and he took loan against property on my mother’s name and attached the property document. Due to some internal issue with the bank, he did not repay the loan. From last 25year we have no correspondence or communication with the bank regarding the loan.

Now both are my parents are dead and we do not have the property papers. What can we do under such circumstances?
We are staying in the property from last 35 yrs.

What is the issue with Bank? Anyhow, when you did not repay the loan, Bank might have been issued notice and published in the Newspaper for default of payment. So your query seems to be not a real one.

The recovery part did not happened.
My father was a Bank Manager with the same bank. and at the same time the the have PF issue from the bank side which s a long story. but the recovery part did not happened...

Your grandfather is your dada ji or nana ji who is stated to have purchased subject property ?
Your mother did not have any siblings / other Legal Representatives of your grandfather or some document which transferred the property absolutely in the name of your mother ?

How did your father managed to take loan against the subject property, where all the LRs of your mother after her death devolved ?
If your father (stated to be a banker) took loan, who is the guarantor / successor ?
Whether the loan account is NPA or still operative ?
Where are the original title documents of the subject property i.e., mortgaged with bank or some where else ?


Various issues have been clubbed in your queries to make it complicated/ confusing.
