Hello i met with accident with bike driver he was hurt in his hand it was his fault and now we both are ready for settlement without going to police station, now i just wanted to know what if i paid him the amount and then he files fir against us even after paying him the expenses, what should i do for my safety.

Settle the matter in writing with a condition that both have agreed mutually without recourse to legal action.

While giving a cheque you shall execute an agreement with the driver by mutual consent with terms and conditions subject to a condition that you both never go to court or any other legal aspects.

The accident must have been reported by hospital where injured got treatment, accordingly MLC shall have to be preparted and matter to be mandatorily reported to police by attending doctor.

You have not posted the complete facts. Were you driving a vehicle? Which type of vehicle? Was the injured and admitted to hospital and MLC prepared? Why you are in hurry to make the settlement?
