Threatned by the stamp registrar

Sir,

I have recently purchased an agriculture land.
Its my First purchase, and due to some misguidance, the officers have found a shortage of Stamp Duty. They have taken a plea that our agricultural land comes under 200m radius of an existing factory and thus have to pay Commercial Stamp.
Neither patwari or the deed writer has given me clue regarding this, else i would have paid the exact stamp then only.
People says that it is a new act , and i have to deposit the difference. I have given application for allowing me to deposit the difference.

The officer is asking for 50% of the stamp difference amount as his service fee. if i don't give that, they will post a heavy penalty on us and then we have to go to some other place for appeal. And that appeal will be submitted only by depositing 33% of the amount.

This is what going on still in U.P. Pl advice me.

Local laws apply for stamp duty which is as per circle rates and usage, where you are required to seek professional services of a local prudent lawyer.

The Sub-Registrar has demanded difference of stamp duty on the basis of some government policy, ask for the same.

Hello,

You have to pay stamp duty and registration charges as per your state's law. Find out whether sub-registrar is demanding legally payable amount. If he is demanding bribe complaint to anti corruption department.

Have you received any official communication demanding the payment? Have you tried to ascertain the norms under which the additional payment is proposed to be levied?

Discuss with local lawyer and proceed accordingly.

If the Sub Registrar (Stamps Registrar as you said) is given an undervaluation notice to you, then in reply you put your valid reasons in it. The Sub Registrar will give you final orders as he thinks fit. If the final orders in your favour, it is ok. Otherwise after receipt final orders, you have to file appeal to Commissioner/IG of Registrations. His orders are final.
