Ex husband making false complaints against me at my work pla

Querist : Anonymous (Querist) 11 June 2020 This query is : Resolved
Hi
I'm a muslim working woman. My first marriage was legally dissolved by family court on 27.08.2019 on ground of non consummation of the marriage. I got remarried on 03.01.2020 as per muslim rituals. I'm working under a renowned PSU. My ex husband has filed false complaints against me in my department regarding polygamy and attending court hearings etc without permission. He has also disclosed personal information regarding previous marriage and divorce petition documents to my office. I feel mentally harassed by these actions of him. What legal actions can i take against him? It is also to mention here that he stays in Rajasthan and I'm residing in Delhi now after remarriage. Kindly requested to give genuine advice please.

First, file a complaint against him by consulting a local lawyer and in women protection cell also. With the proof of divorce decree from your ex-husband request your employer not to take any action as it is a false complaint.

This is nothing but teasing, harasment, defamation and even ransom so this is a police case. Immediately file a police complaint and witness shall be your department officials with whom such false complainats have been moved by your ex-husband.

Seek help of the lawyer appointed / engaged / paid by you for your on-going case for filing an application before the Trial Court besides a criminal complaint for teasing, harashment.
You should also file a separate complaint u/s 12 read with section 17 and 23 of the Protection of Women from Domestic Violance Act, 2005 for necessary protection order(s).

What is the action taken by PSU on those complaints? It is better than such allegation are better ignored and/or taken in the stride.

Hello,

You already got the divorce decree so you can show those documents in your department. Meanwhile file police complaint and send defamation notice to your previous husband.

Whether your department has asked anything from you regarding his complaints?
If yes, reply the letter to the point, after consultation from some senior.
May discuss with the concerned senior in detail.
Discuss with local lawyer and can lodge criminal complaint against him.

One option is to leave counter action and avoid that person. He is out from your life. Once the department has dealt such complaints, it may not take cognizance of the complaints in future if the complaint is repeated.

You have nowhere stated if complaints made by him are false (atleast one) may be fully or partially false.

Without this information nobody can make a considered view whether at all any action is warranted against him or not.

Please come clear with the facts.

The author has mentioned that false complaints were made.

Repeat the suggestion to avoid at present.
