Family settlement deed

(Querist) 28 November 2017 This query is : Resolved
Sir. My father owns some properties in his name. His two brothers also own some property. Now they have agreed to mutually settle by transferring some properties in my father's name to their name and vice versa. Can a family settlement deed be entered? Else what is the best option available. Please help us.
Dr J C Vashista (Expert) 29 November 2017
Family settlement may be preferred seeking services of a local prudent lawyer.
Ms.Usha Kapoor (Expert) 29 November 2017
Family settlement Deed registered once is binding on all the family members your father, your paternal uncles and his children and you etc. This avoids protracted court litigation, money and drain of your energy.

The facts suggest that the transaction may not amount to a family settlement, but rather an exchange of properties.

Register Deed of FAMILY SETTLEMENT , taking help of a local Advocate.

YES FAMILY SETTLEMENT DEED CAN BE MADE DULY MENTIONG THE DETAILS OF PROPERTIES AND WHOSE NAMES THE PROPERTIES ARE LYING AND THE ACTUAL INTEREST OF THE PEROPERTIES LEGALLY . THUS IF ONE BROTHER IS HOLDING PROPERTY IN HIS NAME IT MAY BE BOTH FOR HIMSELF AND HIS TWO BROTHERSL NOW LET US CONSOLIDATE THE IST AND NOW ARRIVE AT THE ACTUAL INTERST AND OWNERSHIP OF THE PRPERTES WHICH WIL CREATE A BASIC DOCUMENT FOR THE SETTLEMENT OF THE ENTIRE PROPERTIES SOT HAT FUTURE COMPLAICATIONS AND MISUNDETSTANIDN WILL NTO ARISE. ALSO THE CHILDREN OF THE BROTHERS WIL BE HAPPY IN FUTURE WITHOUT ANY FAMILY PROBLEMS.

Ungrateful author do not use "like" or "dislike" button in appreciation or depreciation of the Social Service, being FREE OF COST.
Kumar Doab (Expert) 30 November 2017
The detail posted by you is silent on the said properties are self earned/acquired and/or how come each of brother has some interest/share in other properties…!
If the properties in question are independent and there is No possibility of a share/interest in each other’s property then family settlement may not be the right step.

Kumar Doab (Expert) 30 November 2017
Being brothers related by blood they may consider perspectives of gift etc
