Querist : Anonymous (Querist) 02 November 2017 This query is : Resolved
i want to know 1) my husband committed suicide three months ago, due to financial looses now my inlaws are pressurising to sign NOC for leaving all the claims to property and i don't want to do that .what should i do?
2) in laws are saying that they will put allegations that suicide was because of me , the will put allegations on me although there was no postmortem done of suicide, no police complaint registration .do these allegations stand in court?
3) is my mother in law also a legal heir to my husbands own property and not joint

Mother of the deceased son is obviously legal heir and she could make her claims with justifiable grounds

Do not sign any documents and first seek the help of a local good senior advocate and discuss in detail mentioning about their threats also and be protected.

Seems to be quite a vague query.

In suicide case, no cremation seems to be possible without any police report or postmortem thereafter.

THe burden of proof lies heavily on them to prove their allegations of you are behind or respopnsible for his/your husband's suicide. NO police complinat and n post Martem. Such vague allegations do not stand in court without substatial evidence on their side. Donot sign on any paprs given by them.MIL is class1 legal heir of your husband's prioperty along wth his children and widow. So she can claim share in your late husband's property.

The property vests with the legal heirs; under Hindu Law, the mother, wife and the children are the legal heirs, in the normal course.

You can take legal help in case of harassment for whatsoever reason.
