Sucession certificate or letter of administration

(Querist) 19 February 2015 This query is : Resolved 
MY Grand Father Was Died in the Year 1990 in Mumbai Maharashtra. He Left behind no immovable Property but Share Of Listed Company. He Has not Made any will or any other Legal Documents. Now As on I want to transfer such a share in my father name. i have sent all the documents to share transfer agent for transmission of the share. But they specifically asked for succession certificate or letter of administration. Now we all are living in Gujarat. Now My Query is that how to get such certificate. Estimated time and expense required. Specifically in which state court i have to apply. In the share certificate address is in rural area of Maharashtra. Please also suggest way of getting letter of administration.

@Author, you can obtain the Succession Certificate from the court where you are residing. after obtaining the succession certificate, you can apply to the company for the transfer of share. However consult a local lawyer (at Gujarat) who is having knowledge in this matter.

You have to file case for succession certificate either in the place where your father breathed his last or in a place where any of the properties are situate.

Agree with the advise of expert Devajyoti Barman.

However the shares of listed companies can be got transferred by submitting death certificate, legal heir certificate, affidavit and indemnity etc. The process would be cheaper, fast and easier.

but company is asking specifically succession certificate. In Which I Court i have to apply because some lawyer in gujarat said that it is to be apply in maharashtra. Please guide exact law relating to succession certificate.

you can apply for succession certificate in Mumbai wherein your grand father died . it would take around 6 months time to obtain succession certificate . maximum court fees is Rs 75000
