We have done a court marriage. My husband is jain and I m Punjabi …we appointed a lawyer…we have given all the necessary document to the lawyer ie
1)Passport size photos
2)Residential proof (Xerox of Ration card, Licence , Pancard)
3)Date of birth prrof ( School leaving Certificate)
4)Witness (Xerox of identity proof , Photos , Ration card)
We have clicked the photos in front of camera in register office…me and my husand and all witness have signed where the registerar told us to sign…our lawyer give us marriage certificate…we paid 30,000/- to that lawyer . Now after 3years of marriage we decided to get divorce and we went to the registerar office with our marriage certificate. Registrar told us your marriage is not legal bcoz your marriage certificate doesnot have a legal stamp. We are shocked . We have told them to give us that register (book) on which me and my husband and all witness have given the signature .we searched but naot found the signature.We have search for that lawyer . But we can’t find that lawyer. what to do now can you give us some suggestion what to do in this case?

Your Marriage would be Valid Irrespective of Marriage Certificate.Also Both of you do not deny the same and the Marriage Certificate will not be an Issue in your court proceedings for your Divorce.

Yes, the question of proof of marriage would arise only if either of you disputes the factum of marriage.

LODGE POLICE COMPLAINT AGAINST LAWYER AS WELL AS REGISTRAR.
HOW CAN SUCH CHEATING CARRIED ON IN REGISTRAR OFFICE.
MARRIAGE REGN IS VERY SERIOUS MATTER, AND SUCH ACT SHOULD NEVER BE REPEATED.
INFORM BAR COUNCIL..
U MUST HAVE VISITING CARD OF ADVOCATE
PHOTOS SHOWS REGN OFFICE & REGISTRATION..
DON'T LET GO.

IF COURT MARRIAGE WAS NOT REGISTERED, U NEED NOT GO FOR DIVORCE!!!
Proof of marriage is a MUST for Civil Marriage.

Use RTI to get information about record.
Lodge FIR against lawyer and the Registrar. Lodge complaint against the lawyer to Bar Council.

Instead of undergoing the hardships once again, straightaway file a divorce petition before the court of law on the basis of other evidences viz., joint photographs and evidences of joint living,namely Ration card copy or some other documentary proofs, go ahead with the divorce on mutual consent ground, get it dissolved. If you want to take action on registrar and the lawyer, it is a separate issue due to which the main issue will be stranded and set aside.

Since both of u are admitting that u are married to each other, the court may not go into the question of validity of the marriage. Do u have any kids? If so mention the fact and the question of custody of the kids may also arise.

1. You have adequatly been advised by experts, I agree with them.
2. Now it is your turn to engage a local lawyer and apply for a divorce, if you have already decided to part ways.
3. I would advise both of you, it would be better to reconsider and reconsile if possible.
4. If you want to initiate legal action for the alleged cheating and fraud committed by your (then) lawyer and the registrar, engage a local lawyer, collect all possiblle evidences and proceed in the appropriate court as advised by your counsel.

It is unbelievable that the couple signed in the Registers of Registrar of Marriages and the relevant information is missing! The author is misleading the experts.
