Legal heir being denied of information of decaesed

I am one of the legal heir of my father,who passed away in december,2013.My elder brother is the other heir,since my mother is not alive.He has registered our house and another land in his name,without my knowlege,which i came to know after my dad's death.Since my father was a lecturer in a govt college he has some saving and also money in the bank,which my brother n relatives say tat i cannot ask for it sine i am married.There is another land which my bro say tat we can jointly register.He s only using my dad's atm card n money,since he s not workin anywhere.My brother is not allowing me to go inside my house.I am in a fix now.i would like to know what can i do in this situation?

Send a notice to the bank and the employer of your father, narrate your rights as legal heir, send proof for your relationship.

Dear sir,
my father is retired and i am yet to get his death certificate.my brother has got the copies of my dad s dc.he is asking for my marriage certificate to remove my name form the ration card. if my name is removed form the ration card could i still stand to be the legal heir sir?

First try to collect all the copy of documents of yours which had been already transferred to your bro and yet to to be transferred etc from Registrar Office including parent documents and take an EC for 25 years.Show it to a near by lawyer and take a legal opinion.You would know how your bro got the property transferred to his name from this.Also find out whether he had obtained any legal heir certificate.Consult a lawyer and send a legal notice to him you could also fiie a police complaint against him after the opinion of the lawyer.Send a relevant notice to your father's employer and bank.Even if your bro claims as nominee he can not operate the deceased a/c.Ask the bank to block the a/c.Make sufficient proofs to prove you are also legal heir.Do not co operate with him to remove your name from Ration card.Consult a Lawyer

you must be having your education certificates, voter card, joint photos etc. containing your father name. Collect all the documents and proceed as advised by the expert N.J.S.Rajkumar alias narasimha ji.
