Sales tax issue

(Querist) 06 January 2014 This query is : Resolved
Hi Experts,

Owner of a motor parts business expired leaving behind 4 sons as his legal heirs. He had executed IRREVOCABLE POA pursuant to a WILL.

The legal heir's concern is that the SALES TAX No. which was on the proprietorship firms name will continue or the legal heir's will have get a new one? or

can they execute a partnership deed and apply for the amendment in the SALES TAX office so that they can continue the same SALES TAX No.?

Please help legal experts.

Regards,

he will have to get new sales tax number as it was in name of deceased . make enquires with sales tax office

Owner if bequeathed business, the legal heir gets the business, trademark, brand value etc.

POA is only during lifetime. That dies with the principal, as rightly pointed out by Sri Ajay sethi ji

Agree that POA expires on the demise of principal. Consult your tax consultant.
