Difference between a will & nomination

(Querist) 19 October 2013 This query is : Resolved 
why is a nomination for a co-operative society flat/plot not treated as a 'will' when the format or wordings are same and both are endorsed by two witnesses, and also admitted/registered ?

both convey the same meaning that "after my death" the property should be transferred to ................
then how are both different ?

Dear Mr. Yeteendra,
Nomination is the act of authorising some one to receive on behalf of the person nominating. In other words, nominee is the person who is authorised to receive.
A nominee who is authorised to receive (money or anything else) is not the owner of the same. The Nominee after receiving the money or other property, is to hand over it to the other legally eligible person(s).

However, under a WILL, a person in whose name the will is written is the recipient of the bequeathed property. Such a person is called the legatee. Unlike the nominee, the legatee is the owner of the property (or to the act as per the directions contained in the will).

Hope this would clarify some of your basic doubts.
