Mistakes in sale deed

Hi Sir,

I bought a BDA plot in bangalore in 2004. This property was allotted to an individual from BDA (Bangalore Development Authority). The registration was done same day from BDA to allotte and allotte to me. The katha has been transferred to me in 2004 and I have been paying taxes for the past 10 years. Recently I was planning to sell the property and while going thru the sale deed's I found 2 errors.

1. In the original sale deed (From BDA to allotte).
The date and challan number of the money paid to BDA was incorrrect (not matching bank receipt). I do have the original bank receipt from the owner.

Do I need rectification for this?

2. Sale deed from allotte to me

For the seller info, it mentioned W/O (WIFE OF) instead of D/O (DAUGHTER OF) for the seller's father.

It says Ms.x W/O Mr.y instead of Ms.x D/O Mr.y

Do I need rectification for this?

And few more question,


3.How severe these errors to make the deed invalid.

4.Can this be rectified thru the deed rectification.

5.I do not have the seller contact info, can we do the rectification from the BDA to me directly without the seller who sold to me.

6. Will these errors affect my ownership of the property.

This is not a very fatal mistake that cannot be rectified. You can correct it by executing a rectification deed.

1) it is not in dispute that BDA has sold plot to allottee . only challan number and date differs . as on date you dont have seller number . so dont become panicky now after 9 years .
2)unless you have the seller details no rectification deed can be executed .

Thanks for your quick reply. I think the owner is living in Abroad and not able to trace. Can the rectification deed done b/w the BDA ( original owner ) and me without the seller who sold to me for challan data and number?. Is there any alternative to do the rectification deed?

Not much to worry. Rectify if you get the owner. Your title is not affected at all.You can further pass the property with a good title.
