Issue notice to Gen Manager of Bank , Later, depending on his explanation, take action.

Already advised by the experts on your earlier query at the fillowing link:

You have not reponded any further on that thread.

However, you can feel free to sue the bank, if you have enough time and money to spend. Result depends upon production of cogent proof by you, if you have.

the person who received the copy of my bank statement is also an employee of said bank and has clearly mentioned in an application that he has received my a/c statement from bank under rti act 2005. I have authenticated copy of that application. bank staff is bound under banking law to maintain the secrecy of information regarding customer a/cs. also under rti act 2005 there is no any provision to issue private information of customers to unauthorized access. To confirm this I had also asked for my bank statement under rti act 2005. but bank refused with the reason that they are not able to provide me with the asked record. they are discriminating me. so I want to get justice.

I have no grudge against bank. I want to sue bank staff individually. bcos all the misconduct is done by them not by bank.

yes, u can sue.

If you include the Bank as party in the suit, the Bank may nail the miscreant for his act.

The actual fault is of the banker and not of the applicant. Any person may apply seeking information about anyone but the addressee authority has to follow the rules. Moving application is not an offence.
Sudhir Kumar, Advocate (Expert) 29 June 2013
you can request bank totake action against such employee.
