Car parking problem in housing society in navi mumbai

(Querist) 04 May 2013 This query is : Resolved
In our Housing Society we have 28 Stilt Car Parking and 28 Open Parking and we have total 56 Flats in our Society. For Stilt Car Parking the Builder has taken money from all of us and given a letter allotting one specific stilt car park to all the flat owners who paid money.
Out of 28 stilt car parking 8 parking are such where 2 cars can be parked. However, entry and exit to these 8 parking are from one side only. There are no 2 way entries or exit to those parking. Other 20 stilt car parking, only one car can be parked.
Last year General Body (GB) has passed a resolution (by majority voting) that in those 8 parking only one car can be parked (although conveniently 2 cars can be parked without any inconvenience to anybody). Since there is only one side entry and exit, these parking cannot be allotted to two persons to park 2 cars.
After GB resolution, MC has issued circular asking all 8 flat owners to park their 2nd car outside the society and not allowing them to park their 2nd car in their parking slot.
Bye Laws are silent in this respect. Since we do not have majority voting in GB meeting, we will not be able to reverse the decision taken in the GB meeting.

Please advise us what recourse we have?

generally all cooperative societies allot one car parking slot to members . if members have 2 cars they should park one car outside the society premises on account of paucity of space . the resolution passed by AGM is binding on all members

If there is space crunch each flat owner is entitled to one parking space only.

I agree with the reply what Mr. Ajay Sethi Has replied.
However, my question is that in 8 stilt parking, where car parking is one but parking space is long enough so 2 cars can be parked end there is only one entry & exit is there. This has been well explained in my query. In that case why AGM restricting us to park only 1 car instead of 2 cars can be parked.

society has last say in the matter. If you convince majority members then the solution of your problem can be made.

Q.Please advise us what recourse we have?

A.Exercise the option of selling apartments you all own and constructing a spacious bungalow with huge campus in which any number of cars can be parked.

For a CHS ,it's GB is a democratic body whose decisions should be honored to run a CHS smoothly. For your greater needs the only alternative is what i have suggested you here in above.

stilt car parking slot is for one car .
however for your convenience you are parking 2 cars in said slot . if AGM in its wisdom has decided that one car would be parked in each stilt car parking slot it would be binding upon members . the reason would be you would be having 2 cars in society premises whereas other members would have to keep car outside leading to heartburn among members .
