Refund of token money

(Querist) 28 April 2013 This query is : Resolved
Dear Sir,
I have booked a flat in supertech Noida capetown project through a broker named “ALLCHECKDEALS” and given a token money of Rs. 50000 cash on a plain paper receipt duly signed by them and me.
Our deal was that they help me in getting me home loan and after sanctioning of loan I will give bayana to them on account of that property which is 10% of the property cost.
But due to some reasons my home loan application got rejected and the broker is denying refunding my token money.
Is there any legal way to get my money refunded?

there is no clause for forfeiture of earnest money . you have not signed any such agreement . issue legal notice for refund of earnest money

tHE BUILDER IS BOUND TO RETURN THE EARNEST MONEY, NOT THE BROKER. GO TO THE CONSUMER FORUM FOR NECESSARY RELIEFS.
