The query seems to be of general nature and for information. Counter claim is a claim made by the defendant against the plaintiff in a law suit which is included in the defendant's written statement and is intended to off set or reduce the amount claimed by the plaintiff. You may refer to Order 8 Rule 6A of the CPC. Also see the decision of Bombay HC in Manick chand Vs Lalchand- AIR 1994 Bom 196.
