Should i use tep?

Guest (Querist) 04 April 2013 This query is : Resolved
My FIL is government servent. My wife mentioned that they did 4 lakhs expenses during marriage. Is TEP beneficial to get some relief in 498a?

You are very much entitled to summon the IT returns of the father of your wife for the relevant period so as to falsify her claim but it is not always advised.

After all prosecution has to prove the allegations and you need not to lead evidence while doing so but if the demand of the case requires only then such course should be resorted. Your lawyer is the best master of your case so better to follow him.

Rs 4 lakh is no big amount these days. I do not see any merit regarding this.

Thanks Makkad ji and Barman ji,

But they did not do this much expenses also as per me.

Then dispute this in your defence.

Thanks.

Let them bring evidence in support of their claim. If they fail in performing your duty, you shall get benefited.

At the time of trial of your case you can get information from the Income Tax authority through RTI application and submit it to the court.

No S.271(1)(c) penalty in absence of finding that return filed is incorrect or erroneous or false
A glance at the provisions of section 271(1)(c) of the Income-tax Act, 1961, suggests that in order to be covered by it, there has to be concealment of the particulars of the income of the assessee. Secondly, the assessee must have furnished inaccurate particulars of his income.

Not only demand but also offering and giving of dowry is offence which gets admitted in this case by your opponent then why not you pray court to order police to investigate and book them for their admitted offence first.?does not it sound simple?

al marriage gifts do not come under dowry as held by the supreme court recently.
prabhakar singh (Expert) 04 April 2013
You compelled to return Mr.Barman.

Dowry and gift are two distinct things.
Good night.!!!!!!!!!!!1
