Partnership dispute

(Querist) 06 September 2012 This query is : Resolved
My sister, a widow is a 25% partner in a partnership firm managed by her inlaws. For the past two years they have stopped giving her any financial details regarding her share of profit, partners remuneration, Interest on capital etc. She does not have any access to the accounts of the firm. They have also not allowed her to withdraw her available balance of capital from the firm for past two years.
Can any one guide me how to get the financial details so that I can file her Income Tax returns.
Also can any one show me the legal way to get my sisters money from the firm.

Every partner has right to take part in business - Subject to contract between partners (to the contrary), every partner has right to take part in the conduct of the business. [section 12(a)].

Send legal notice then approach jurisdictional court through advocate.

After submission of legal notice, your sister should file a suit for rendition of accounts before the civil court of that area wherein such partnership firm works or performs its business.

Send a legal notice for rendering of account,if not given, file a suit of accounting and dissolution of the firm, but doing that be sure about the fact that Firm is Registered with registrar of the firms,if not, first get it registered ,then file the suit. All this would need help of a competent local Civil lawyer.
