Dear Sir/Madam,

In pending DV case filled by wife.

Q) if respondent had filled an application of u/s 340 CrPC and at the same day wife filled application of Distress warrant in the trial court.

which application trial court will consider first u/s 340 CrPc for committing perjury or application of distress warrant?

Both can be heard and orders may be passed on merits.

Yes. But since the perjury application is subject of inquiry and trial by some other court it may take time.

In the mean time DW would be issued to enforce the payment of arrears maintenance.
